New Mexico Prescribed Burning Act - History and Update

In 2016, the New Mexico House of Representatives passed House Memorial 49 (see link below). In 2019, the New Mexico House of Representatives passed House Memorial 42 (see link below). This memorial called for a working group to convene and study how the use of prescribed fire could be expanded in New Mexico. Results of the effort (see report link below) were submitted to the Legislature on July 1, 2020. In combination with these efforts, House Bill 57 (see link below) was introduced into the 2021 New Mexico legislative session. The draft legislation received strong support from stakeholders across the state during the session and likewise, broad bipartisan support in both the NM House and Senate chambers. Following passage from lawmakers, the bill was sent to the Governor's office for signature on March 18, 2021. It is our understanding that the Act is in affect now in New Mexico even though the rules are still being developed. See the final version of the bill below. The draft rules governing the Act are posted below. Comments to the NM Forestry Division on the draft rules are due December 14. Stay tuned for more information...

Summary: Thanks to everyone who attended the 2021 New Mexico Prescribed Fire Council Meeting last week. We had about 30 people attend what was a great event. For those of you that couldn't’t make it, below is a link to view the recording of the meeting. The New Mexico Prescribed Fire Council, NM State Forestry, and the Chama Peak Land Alliance have partnered to host a regional workshop for the benefit of anyone interested in using fire as a management tool on their private land. Using prescribed fire on private lands can be challenging. Landowners may not have the information, labor, equipment, and expertise necessary to conduct prescribed burns in a safe and confident manner. Join us for our workshop where experienced burners and folks knowledgeable on what it takes to set up and implement burns will talk about the following subjects:

  • NM State Laws and How They Pertain to Rx Burning
  • NM Smoke Management Program
  • Basic Weather Issues Related to Rx Burning
  • Basic Burn Plan Requirements
  • Fire Effects - What Can I Expect After Fire? How Will Vegetation Respond to Fire?

  • Liability Issues and Insurance Avenues
  • Rx Fire Funding Assistance and Opportunities

The New Mexico Prescribed Fire Council, Arizona Prescribed Fire Council, Malpai Borderlands Group, Hidalgo Soil & Water Conservation District, and the Whitewater Draw Natural Resources Conservation District hosted a regional workshop for the benefit of anyone interested in using fire as a management tool on their private land. In addition to useful information being presented about Rx fire, the collaborative effort between NM and AZ allowed participants to compare and contrast prescribed fire policies between the two states. The New Mexico Prescribed Fire Council hosted a second regional workshop for the benefit of anyone interested in using fire as a management tool on their private land. The workshop concluded with a presentation and picture tour of Sid Goodloe's ranch. He presented a history of the ranch and his use of Rx fire. Rain precluded a planned field trip of the ranch. Thank you Sid and Cheryl! Lunch was generously provided by the South Central Mountain RC&D and the Upper Hondo Soil and Water Conservation District - thank you!

The New Mexico Prescribed Fire Council held a regional workshop for the benefit of anyone interested in using fire as a management tool on their private land. Sixty four people attended. The workshop concluded with a tour of Greg Moore's ranch to see where he has used Rx fire in the past. Thanks to the Moore family for their hospitality. Lunch was provided by the Mora-Wagon Mound Soil & Water Conservation District, Tierra y Montes Soil & Water Conservation District, and Adelante Resource Conservation & Development Council.
